Lawn Maintenance Terms & Conditions
Contractor Responsibility
M Linton Lawn Care Service LLC shall perform work in accordance with the written terms contained or referred to in this agreement. M Linton Lawn Care Service LLC reserves the right to renegotiate the contract when price or scope of work is affected by changes to any local, state, or federal law, regulation or ordinance that goes into effect after the Agreement is signed. Or changes requested by customer. All employees shall be competent, qualified and shall be United States citizens or legal residents authorized to work in the United States. M Linton Lawn Care Service LLC may be represented as “Contractor” within this agreement.
Insurance & Liabilities
Contractor agrees to provide General Liability Insurance, Automotive Liability Insurance and any other insurance required by law. It is understood and agreed that the Contractor is not liable for any damage of any kind that is not caused by the negligence of the Contractor, its agents or employees. Contractor will comply with all licenses and permit requirements of the city, State, and Federal Governments, as well as all other requirements of law.
Billing
Lawn mowing is invoiced at the time of each service. The customer is required to always keep an active credit or debit card on file and this card will be charged at the time of each service. If the card is declined at the time of service, the contractor will charge the card again the following day. If the card is declined again a $5.00 service fee will be added and the contractor will attempt to charge the card again five days after the time of service. If the card is again declined, service will be paused until payment is made. The customer may also pay via PayPal or electronic Invoice payment prior to service or no later than at time of service.
(*Any invoices that are 30 days past due will be charged a late fee of $30 from the date of the invoice for each month it is past due and in the event of default collection charges and/or attorney fees will be additional. Services will be cancelled immediately until payment is received to bring account current)
(*Customers have (48hrs) from the time the job is complete to notify Contractor of any dissatisfaction regarding any job done by Contractor through the customer portal or by email to mlintonlawncareservice@gmail.com . If there is no contact made within 48hrs, it is agreed that the job was complete to satisfaction and reimbursement should not be expected*)
Lawn Mowing
During each visit as needed, we will remove normal trash and debris from lawn areas and dispose of as appropriate, mow lawn areas, trim turf areas (around trees, mailboxes, mulch beds, along fence, etc.), edge sidewalk, driveway and curbs, if established as appropriate. To establish an edge for a sidewalk, driveway and/or curb will be a one-time additional fee.
* Contractor does not bag clippings. Grass clippings are a valuable, natural source of nitrogen which is vital for a healthy lawn.
**If there are excessive items in the yard such as lawn chairs, fire pits, toys, water hoses or other items, they will not be moved by a Contractor employee. However, if Contractor’s employee feels a few items can be moved with reasonable effort and if there is little risk of damaging the item(s) they may move the item(s). It is the employee’s prerogative to make the determination as to which items do or do not meet these criteria. Contractor will notify the customer regarding concerns of excessive items. After notification Contractor may charge a fee of $10 per service for excessive items that require relocation to complete the contracted services.
***Removal of fallen branches is not included in our basic service. Fallen branches will be piled in one location off the turf, if possible. ****Bagging of clippings is not included in the basic service. It is better for the lawn to have the clippings recycled into the lawn. *****Due to potential damage; Contractor team members are not permitted to trim any grass or weeds growing in cracks of hard surfaces (asphalt, concrete, etc.), in mulch or flower beds, behind a/c units, or around any small rocks. Should you require maintenance around these areas; please contact us for an estimate to provide this service. Before each mowing, normal trash and debris will be removed. Personal items in the yard must be removed by customer prior to mowing. Mowing will be performed every 7-14 days, depending on growth rate and schedule preference. A turf height between 3 ½ -5 inches will be maintained without removing more than 1/3 of the total grass blade height. The mowing direction will be alternated each visit, whenever possible, to prevent compaction and enhance your lawn’s appearance. Our equipment is maintained under a regular schedule to ensure excellent working conditions and safety. Change in schedule is by customer decision and must be requested only by emailing Contractor for paper trail purposes. Switching between weekly and bi–weekly service can result in price adjustments based on current rate of services.
Service Scheduling
You will be assigned a regular service date based on your property’s location and should assume that your service will occur on that day. If we are unable to service your property that day due to weather conditions or other circumstances, we will notify you via email, call or text message and provide you with the makeup date. We begin servicing properties at 8am and do not work weekends except under extreme circumstances. Due to the evolving nature of lawn maintenance service routes, your service date may change but we will notify you via email/text if this occurs.
*Special Event Service outside of your scheduled service day and/or week will incur an inconvenience fee of $15, if the requested Special Event Service Day/week is available. For bi-weekly customers that request service on their non-service week, they will maintain their agreed bi-weekly service day which will likely require consecutive weeks of service directly following the Special Event Service booking day to maintain the initial agreed service schedule.
Property Lines
Prior to the commencement of the Work the customer will provide Contractor with information as to the location of property lines and all subsurface utility and service lines, including but not limited to tree/shrub stumps, electrical, telephone, gas lines, water and irrigation pipelines and conduits, if applicable. Contractor may rely on the accuracy and completeness of all such information and shall not be liable for damages or costs resulting from any errors or omissions in that regard.
Property Accessibility
On your regular service day, it is the customer’s responsibility to provide access to all gated service area(s) at time of service. Inaccessibility to the service area(s) will inhibit Contractor from completing the Work. Our team member will attempt to contact the customer to gain access to the service area, but if a key, instruction of how to access the service area is not provided at time of service this area will be skipped until the next scheduled service. The service visit will be billed the agreed service rate. It is the discretion of Contractor, if an alternative service date can be provided when access to the Work area is available. This alternative service date will incur a delayed service fee of $10, if feasible for the Contractor’s schedule.
Pets
For safety reasons, Contractor team members will not enter a front, side or backyard if a pet (cat, dog, turtle, etc.) is loose in that area. If an animal is in one of these areas, it will be considered unserviceable at that time. The team member will attempt to contact the homeowner, but if unsuccessful in this attempt, the team member will service what areas are safely assessable and the customer will be billed for the full-service amount and the non-serviced area(s) will be serviced on the next scheduled service date.
If there is pet waste, such as dog feces in yard Contractor will assess a fee of $10 - $50 based upon the size of the yard and amount of feces in the yard. It is the employee’s responsibility to determine the fee amount. Contractor does not want to coat or damage our equipment with the pet waste. Any pet waste collected will be disposed of at the customer’s site. Access to customer’s water spicket may be necessary for rinsing off equipment at the end of the service.
Client Responsibility
Access to job Site, Prompt Payment, Notice of Defect or Damage to be reported within 48 hours to the Contractor. In most cases, Contractor will address or remedy the problem within two to five days after receiving Client’s request. In some cases, it may take longer, depending on circumstances beyond Contractor’s control (including, but not limited to weather, inappropriate time of year to correct the turf or landscape problem, or non-availability of materials).
Service Cancellation
Service cancellation can be initiated at any time, for any reason, by either party and will take effect immediately unless otherwise specified. The only exception to this will be if cancelation is requested while a service is being performed. In this case, the cancelation will be processed once the service is completed and the service is paid is full. Service should be canceled via email and the customer will receive cancelation confirmation sent to the email we have on file.
